The recent enactment of Pennsylvania’s Gas and Hazardous Liquids Pipelines Act No. 2011-127 (Act 127) expanded the Pennsylvania Public Utility Commission’s (PaPUC) jurisdiction over pipeline operators who transport gas or hazardous liquids by pipeline in Pennsylvania. Among other things, Act 127 provides that all pipeline operators must register with the PaPUC, and any failure to properly register “shall subject the pipeline operator” to various civil penalties. Act 127 applies to pipeline operators that are engaged in the transportation of gas, which is defined as the “gathering, transmission, or distribution” of gas by pipeline. Transportation of gas does not include “production operations,” which are therefore exempt from Act 127.
